Perlindungan Hukum atas Pelayanan Kesehatan Ditinjau dari Undang-Undang Nomor 36 Tahun 2009 serta Hukum Internasional

This study analyzes legal protection of health services based on Law Number 36 of 2009 concerning Health and its conformity with international legal principles regarding the right to health. This research is a normative legal study using statutory, conceptual, and comparative approaches. The results show that Law Number 36 of 2009 has provided a fairly strong normative basis for legal protection of health services through recognition of the right to health, government obligations, regulation of health service facilities, and the responsibilities of health personnel and service providers. That legal protection covers both preventive and repressive dimensions. However, its implementation still faces various obstacles, such as unequal access to health services, limited facilities in remote areas, weak oversight, and low public legal literacy. Compared with the Universal Declaration of Human Rights, the International Covenant on Economic, Social and Cultural Rights, and General Comment No. 14, national regulations are essentially normatively aligned, but not yet fully effective in meeting the principles of availability, accessibility, acceptability, and quality. Therefore, it is necessary to strengthen harmonization of national law with international standards, enhance oversight, and optimize mechanisms for protecting and restoring patients’ rights so that legal protection of health services can be realized more fairly and equitably.
